By clicking the "ACCEPT" button to install System software, or otherwise installing or using the System, you agree (i) to be bound by the terms and conditions of this End User License Agreement ("EULA") without limitation or qualification, (ii) represent that you are of legal age, (iii) represent that you are authorized to enter into this EULA on behalf of yourself, the owner and resident(s) of the home in which the System is installed and any party to whom you grant access to the System, (iv) represent that, both now and at any time subsequent hereto that you use the System, you are the owner of and authorized to access and operate the Garage Door Opener(s) or other products or systems that may be remotely operated through the System, (v) you consent to use electronic communications, electronic records electronic signatures, and (vi) that your electronic signature is the legal equivalent of, and is as valid as, your handwritten signature.
This EULA relates the use of the Genie Aladdin Connect® remote door/barrier activation, operation and monitoring products, systems and services, including web and mobile device application software, software and firmware used in connection with such products and communications networks, and software allowing web-based interface and underlying functionality and access to such services (collectively, the "Genie Services" or "Services") and the licensure of software products identified above, which includes any future versions, releases, updates, patches, error fixes and bug fixes of the above software ("Software"). For convenience, we refer to the combination of products, Software, and Services we provide to you as the "System". Genie, when used herein, shall mean GMI Holdings, Inc., d/b/a The Genie Company, and its parent company.
The System includes software owned by Genie and software licensed to Genie, which is protected by United States and international copyright laws and treaties, as well as other intellectual property laws and treaties. Subject to the terms of this EULA, Genie grants you a limited, revocable, non-exclusive, non-transferable license (without the right to sublicense) to use the System, and its related Software, solely for your personal use in the United States and Canada. The foregoing license includes the right to install the Software on your personal computer, tablet and/or mobile device and to use the Software in conjunction with your licensed use of the System. Unregistered use, reproduction and distribution of the System is not permitted by Genie and is in violation of U.S. and international copyright laws and is subject to civil and criminal penalties. You are specifically prohibited from making or distributing any copies of the System. All rights of any kind in the System and all other rights of Genie, which are not expressly granted in this EULA, are entirely and exclusively reserved to and by Genie (including the software object code and source code). You agree not rent, lease, copy, modify, or translate the System, or create derivative works based on the System. You agree to not reverse engineer, perform penetration testing, or otherwise attempt to identify vulnerabilities in the System without our prior written approval. You may not alter or remove any of Genie's copyright or proprietary rights notices or legends appearing on or in the System. Except as expressly set forth herein, you agree not make access to the System available to any third party, nor are you authorized to make the output generated by or the results of any performance or functional evaluation of the System available to any third parties.
The System may contain or be derived from materials of third-party licensors. Such third-party materials may be subject to restrictions in addition to those listed in this EULA. You agree that any third-party supplier shall have the right to enforce this EULA with respect to such third party's software. If any Software is being licensed under the terms of a proposal or agreement with the U.S. Government or on the U.S. Government’s behalf, the Software is commercial computer software that was developed exclusively at private expense, and (a) if acquired by or on behalf of a civilian agency, shall be subject to the commercial computer software license terms set forth in this Agreement as specified in 48 C.F.R 12.212 of the Federal Acquisition Regulation and its successors; or (b) if acquired by or on behalf of units of the Department of Defense, shall be subject to the commercial computer software license terms set forth in this Agreement as specified in 48 C.F.R 227.7202, Defense Federal Acquisition Regulation Supplement and its successors.
You agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the registration form and (b) maintain and promptly update such information. You must create a username and password to access the System. If you are provided with a temporary username and password, you must modify the temporary credentials and create your own username and password. You are responsible for maintaining the confidentiality of your password and account and you are fully responsible for all activities that occur under your password, account or any subaccount. You agree to (a) immediately change your password in the event of any breach of security, and (b) ensure that you exit from your account at the end of each session. You agree that the terms of this EULA will be binding upon and govern the relationship between Genie and any third party to whom you grant access to your account or permit to maintain a subaccount. You further agree to take any and all action necessary to ensure compliance with, and enforce the terms of, this EULA, and to indemnify Genie for any and all costs, damages, losses or expenses incurred in respect of such third-party user. Genie will not be liable for any loss or damage arising from your failure to comply with this Section.
You acknowledge and agree that you have the option to add additional parties to your account and such parties will have full access to the System, including, but not limited to, the ability to view your usage history and open, close and monitor your garage door. You further acknowledge and agree that Genie has no responsibility to you with respect to the actions of such parties.
This EULA is effective on the day you first use the System and will continue for so long as you continue permitted licensed use the System. Genie may immediately terminate this EULA at any time if you fail to comply with any of the terms hereof, including (if applicable) failure to make any required System License Fee payments. Genie may also suspend or terminate a user account due to inactivity. Upon termination of this EULA, the license granted hereunder will terminate and you must stop all use of the System immediately. In the event the license granted hereunder is terminated, Genie shall have no liability to you for any costs, expenses or loss of use. Genie reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the System (or any part thereof) with or without notice. You agree that Genie will not be liable to you or to any third party for any modification, suspension or discontinuance of the System.
You may incur additional fees from third party providers in connection with your use of the System, an independent handheld device, or the internet for data transmission, internet usage, SMS, short code or other transmission fees, charges or taxes, which are solely your responsibility.
Genie reserves the right, at any time, to begin charging you License Fees for your access to or use of the System under this EULA ("License Fees"), and/or to increase or modify License Fees, for your access to or use of the System. If Genie elects to charge License Fees and you wish to continue to access and use the System, you must: (i) enter into a subscription agreement on terms and conditions specified by Genie, (ii) make acceptable payment arrangements with Genie, and (iii) pay the applicable License Fee to Genie. If you fail to do so, your ability to access the System will automatically terminate at a time determined by Genie in its sole discretion. You will be responsible for paying any and all sales, use, excise, personal property or other taxes of similar nature levied upon License Fees for your access to or use of the System.
YOU UNDERSTAND AND WARRANT THAT IF YOU SELL YOUR HOME AND LEAVE SYSTEM HARDWARE AT YOUR FORMER HOME OR OTHERWISE TRANSFER OWNERSHIP OF ANY SYSTEM HARDWARE, YOU WILL DELETE SUCH SYSTEM HARDWARE FROM YOUR ACCOUNT SUCH THAT THAT YOU MAY NO LONGER ACCESS THE GENIE SYSTEM ASSOCIATED WITH SUCH SYSTEM HARDWARE AND/OR YOUR FORMER HOME. YOU WILL INDEMNIFY AND DEFEND GENIE FROM AND AGAINST ANY BREACH OF THE WARRANTY IN THIS SECTION.
THE SYSTEM IS PROVIDED AS IS, AND WITH NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, AND GENIE EXPRESSLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK ARISING OUT OF USE, PERFORMANCE OR NON-PERFORMANCE OF THE SYSTEM REMAINS WITH YOU. TO THE FULLEST EXTENT PERMITTED BY LAW, GENIE DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE SYSTEM.
GENIE AND ITS THIRD-PARTY SERVICE PROVIDERS HAVE NO LIABILITY FOR THE CHOICE OF ROUTERS, NETWORKING EQUIPMENT OR OTHER PRODUCTS INSTALLED AT YOUR PREMISES, OR THEIR INSTALLATION, CONNECTION, OPERATION, OR COMPATIBILITY, OR FOR ANY INTERFERENCE CAUSED THEREBY. YOU EXPRESSLY UNDERSTAND AND AGREE THAT GENIE DISCLAIMS ANY AND ALL RESPONSIBILITY OR LIABILITY FOR (1) THE ACCURACY, COMPLETENESS, RELIABILITY, OR OPERABILITY OR AVAILABILITY OF ANY CONTENT OR INFORMATION OR MATERIAL PROVIDED BY OR ACCESSIBLE THROUGH THE SYSTEM; AND (2) THE USE OF OR INABILITY TO USE THE SYSTEM; AND (3) THE DELETION, FAILURE TO STORE, MIS DELIVERY, OR UNTIMELY DELIVERY OF ANY INFORMATION OR MATERIAL; AND (4) BREACHES OF SECURITY; AND (5) INFORMATION COMMUNICATED THROUGH MESSAGE BOARDS OR OTHER FORUMS; AND (6) ANY OTHER FAILURE TO PERFORM BY GENIE; AND (7) DAMAGE, INJURY, OR LOSS OF LIFE OR DAMAGE TO PROPERTY.
IF GENIE SHOULD NEVERTHELESS BE FOUND LIABLE, WHETHER DIRECTLY OR INDIRECTLY, FOR ANY LOSS, DAMAGE OR INJURY ARISING UNDER THIS AGREEMENT OR OTHERWISE, REGARDLESS OF CAUSE OR ORIGIN, ON ANY BASIS WHATSOEVER, (INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE), ITS TOTAL MAXIMUM LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU FOR YOUR ALADDIN CONNECT HARDWARE, WHICH WILL BE THE COMPLETE AND EXCLUSIVE REMEDY AGAINST GENIE. IN ADDITION, IN NO EVENT WILL GENIE OR ITS PRINCIPALS, SHAREHOLDERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, SUBSIDIARIES, OR SUPPLIERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER RELATING TO THE USE OF THE SYSTEM OR ANY COMPONENT THEREOF OR TO YOUR RELATIONSHIP WITH GENIE, EVEN IF GENIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
UNDER NO CIRCUMSTANCES WILL GENIE BE HELD LIABLE FOR ANY HARM RESULTING FROM DOWNLOADING OR ACCESSING ANY INFORMATION OR MATERIAL THROUGH THE SYSTEM, ANY DELAY OR FAILURE IN PERFORMANCE RESULTING DIRECTLY OR INDIRECTLY FROM ACTS OF NATURE, FORCES OR CAUSES BEYOND ITS REASONABLE CONTROL, INCLUDING, BUT NOT LIMITED TO, INTERNET FAILURES, COMPUTER EQUIPMENT FAILURES, TELECOMMUNICATION EQUIPMENT FAILURES, OTHER EQUIPMENT FAILURES, ELECTRICAL POWER FAILURES, STRIKES, LABOR DISPUTES, RIOTS, INSURRECTIONS, CIVIL DISTURBANCES, SHORTAGES OF LABOR OR MATERIALS, FIRES, FLOODS, STORMS, EXPLOSIONS, ACTS OF GOD, WAR, GOVERNMENTAL ACTIONS, PANDEMICS OR EPIDEMICS, ORDERS OF DOMESTIC OR FOREIGN COURTS OR TRIBUNALS, OR THE PERFORMANCE OR NON-PERFORMANCE OF THIRD PARTIES.
The System is intended to allow users to remotely operate and monitor garage door and barrier operators and other similar equipment connected to the System.
WARNING: TO REDUCE THE RISK OF SERIOUS INJURY OR DEATH, NEVER PERMIT CHILDREN TO ACCESS, USE, OPERATE OR PLAY WITH THE WEB INTERFACES, MOBILE APPS OR OTHER PARTS OF THE SYSTEM, AND AVOID USE ANY WEB INTERFACES, MOBILE APPS OR OTHER PARTS OF THE SYSTEM WHILE DRIVING.
THERE IS NO GUARANTEE THAT THE SYSTEM WILL PROVIDE ERROR-FREE OPERATION, OR THAT IT WILL NOT BE COMPROMISED OR CIRCUMVENTED, OR THAT IT WILL PREVENT ANY PERSONAL INJURY OR PROPERTY LOSS CAUSED BY BURGLARY OR ROBBERY. THE FURTHER, THERE IS NO GUARANTEE THAT THE SYSTEM OR YOUR MOBILE DEVICE OR COMPUTER WILL TRANSMIT OR RECEIVE ALL SIGNALS SENT BY OR TO YOU REGARDING THE SYSTEM, INCLUDING, BUT NOT LIMITED TO, SIGNALS REGARDING THE ACTIVATION OR DEACTIVATION OF YOUR GARAGE DOOR OPENER. YOU ACKNOWLEDGE THAT THE SYSTEM WILL NOT PREVENT OR DETECT A BURGLARY, ROBBERY, FIRE OR OTHER EVENT, THAT THE SYSTEM IS NOT A SECURITY SYSTEM OR INSURANCE POLICY, AND THAT THE SYSTEM DOES NOT PROVIDE CENTRAL STATION OR OTHER MONITORING OR FIRE, SMOKE, HEAT, MOTION OR OTHER ALARM OR DETECTION CAPABILITIES. YOU ACKNOWLEDGE THAT THE AVAILABILITY OF THE SYSTEM SERVICES IS DEPENDENT ON YOUR COMPUTER, MOBILE DEVICE, HOME WIRING, YOUR INTERNET SERVICE PROVIDER, YOUR SATELLITE PROVIDER, AND YOUR MOBILE DEVICE CARRIER, FOR WHICH GENIE IS NEITHER RESPONSIBLE NOR LIABLE, AND YOU ACKNOWLEDGE THAT YOU ARE RESPONSIBLE FOR ALL FEES ASSOCIATED WITH SUCH USE AND FOR COMPLIANCE WITH ANY AGREEMENTS RELATED TO SUCH USE. YOU FURTHER ACKNOWLEDGE THAT GENIE AND ANY NETWORK SERVICE PROVIDERS CANNOT GUARANTEE THE SECURITY OF ANY WIRELESS TRANSMISSION AND WILL NOT BE LIABLE FOR ANY LACK OF SECURITY RELATING TO THE USE OF ANY SERVICE. GENIE WILL HAVE NO LIABILITY FOR ANY PERSONAL INJURY, PROPERTY DAMAGE OR ANY OTHER LOSS BASED ON A CLAIM THAT THE SYSTEM FAILED TO OPERATE PROPERLY AND YOU HEREBY RELEASE GENIE FROM ALL LIABILITY RESULTING THEREFROM. GENIE MAKES NO GUARANTEE THAT THE SYSTEM WILL BE COMPATIBLE WITH ALL COMPUTERS, HANDHELD DEVICES, ROUTERS OR GARAGE DOOR OPENERS. YOU SHOULD FIRST TEST THOSE DEVICES AT HOME FOR COMPATIBILITY BEFORE USING THEM AWAY FROM HOME.
The failure of Genie to enforce at any time any of the provisions of this EULA will not be construed to be a continuing waiver of any provisions hereunder nor will any such failure prejudice the right of Genie to take any action in the future to enforce any provisions hereunder. Software and technical information delivered under this EULA are subject to U.S. export control laws and may be subject to export or import regulations in other countries. You agree to strictly comply with all such laws and regulations, and you will be solely responsible for obtaining any import, export, re-export approvals and licenses required for such software any technical information and retaining documentation to support compliance with those laws and regulations. This EULA will be deemed entered into in the State of Texas and will be governed by and construed according to the laws of the State of Texas, without regard to conflict of law principles. Any action against any party to this EULA will be commenced only in the federal or state courts within the State of Texas, which courts will have exclusive jurisdiction over such actions and proceedings and the parties hereby irrevocably consent to personal jurisdiction over them by such courts. You agree that any applicable state law implementation of the Uniform Computer Information Transactions Act (including any available remedies or laws) shall not apply to this EULA and is hereby disclaimed. It is understood and agreed that, notwithstanding any other provisions of this EULA, breach of any provision of this EULA by you may cause Genie irreparable damage for which recovery of money damages would be inadequate, and that Genie will therefore be entitled to obtain timely injunctive relief to protect Genie's rights under this EULA in addition to any and all remedies available at law.
This EULA, including the Privacy Statement, the applicable limited warranty, and, if purchased directly from Genie, the terms and conditions of sale that accompanied your purchase of any equipment from Genie, forms the entire agreement between you and Genie and supersedes in their entirety any and all oral or written agreements previously existing between you and Genie with respect to your access to and use of the System and related Services. In the event of any conflict between this EULA and any other such agreement or document, this EULA shall govern. This EULA may be amended from time to time by Genie, provided that in such event, you shall be prompted by the System to review and accept such updated terms and conditions.
Neither this EULA nor any of the rights, interests or obligations provided by this EULA may be transferred or assigned by you without the prior written consent of Genie. Genie may assign this EULA, in whole or in part, in its sole discretion. This EULA will be binding upon the parties and each of their present and future officers, directors, employees, parents, subsidiaries, agents, successors, assigns, contractors, licensees, affiliates, family members and guests and authorized users. The provisions of this EULA will apply to the fullest extent permitted by law and be interpreted and applied to a lesser extent, where necessary to be valid. The invalidity or unenforceability of any provision of this EULA will not affect any other provision and all such other provisions will remain in full force and effect without change or modification thereof. You consent to the exclusive use of the English language in this EULA, as well as in all communications from Genie.
If you choose to use the System with any service or device from anyone other than Genie, for example a voice-enabled command system such as Alexa, you acknowledge and agree that you authorize Genie to (i) perform the actions and (ii) share the information or requests provided to or received by Genie in connection with your use of or access to any third party service or device. Any communication in connection with the System, whether to or from a third-party device or software system that you use shall be deemed a communication authorized by you. You agree that Genie may provide such third party with information regarding your System. Without limitation, this includes information such as status of the garage door (open or closed). Genie reserves the right in its absolute discretion to (i) decline to communicate with or (ii) stop communicating with any site (or group of sites), system or device offered by any third party. The System may be used with products or services from third parties that Genie did not provide, develop or manufacture. Genie has no responsibility or liability (i) for such products or services; (ii) the integration of the System with such products or services; or (iii) any problems, injuries, losses, or damages caused by or attributable to such products or services.
TThis EULA is concluded between you and Genie, and not with Apple or Google. Genie is solely responsible for the System and the content thereof. The license granted herein is limited to use of the licensed application on any device which you own or control as permitted by the App Store Terms of Service Usage Rules. Apple and Google have no obligation to furnish maintenance or support services with respect to the System, or for any product or intellectual property claims concerning the System. You represent that you are not located in a country subject to US embargo or that has been designated as a "terrorist supporting" country and that you have not been listed on any U.S. Government list of prohibited or restricted parties. Apple and Google and their respective subsidiaries are third party beneficiaries of this EULA and upon your acceptance will have the right to enforce the terms of the EULA against you.
We may collaborate with an independent third-party service provider in your area (a “Dealer”) and, if you have enabled the support services feature, you may be able to communicate with a local Dealer and they may contact you about repair services. If you have enabled this feature, you authorize Genie to share information about you, your account, and your device with a Dealer for the purpose of contacting you for repair and planned maintenance services.
You acknowledge that Genie does not have control over the third-party Dealer, and you agree that Genie is not liable for any damage or loss arising out of your decision to retain the Dealer’s services. Genie does not make any representations or warranties regarding, and accepts no responsibility for, the services a Dealer performs for you. Accordingly, you agree that any arrangements with a Dealer to perform services will be solely between you and the Dealer, and that Genie shall have no liability to you as a result of your decision to engage the Dealer to perform a product repair.
You also hereby consent to the Aladdin Connect® system intercepting, recording, retrieving, reviewing, copying, disclosing and using, for purposes of providing the Aladdin Connect® features and services, the contents of all communications between you and a Dealer that are conducted through Aladdin Connect® and/or connected app to which you or your emergency contacts are parties.

In the event you change your mind at a later date, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, or modify your contact information, by sending a request with sufficient detail that allows us to properly understand, evaluate, and respond to the email address listed above and indicate on the subject line, “Privacy Compliance.” Please also note that the Systems may be hosted in countries other than yours, including the United States. By accessing the Systems, you expressly consent to the exclusive use of the English language, and the transfer of your information outside of your home country, which may provide for different data protection rules than in your country.
Genie’s Collection of Information. When you establish an online account or register on our Systems, we may collect information about your name, user identification, password, email address, zip code, and secret questions and answers. When you purchase products or apply for service with Genie, we may also obtain credit information about you from outside credit reporting agencies to help us with customer authentication and credit-related decisions. Genie may use the information we have collected to fulfill your requests, administer programs, provide services, train our employees, and for other business purposes. We may also use the information you provide to send you marketing communications. At any time you may update and correct your personal information, request that we delete your personally identifiable information, or deactivate your account. This can be done by logging into your account to make the change or by contacting Genie using one of the methods listed above.
Genie’s Systems and/or mobile applications may use location-based services. For example, our Systems may allow you to search for a store that sells Genie products. If you access our Systems through a mobile device or desktop device and you have enabled location-based services, specific location information may be collected. Your mobile device and desktop web browser may allow you to disable location-based services, which will prevent our Systems and/or mobile application from accessing your location information. We recommend you review the “help” or user manual for instructions on how this can be done.Genie’s Systems and/or mobile applications may use your home zip code, home system configuration (e.g., devices used in connection with the System, System status, and/or security or lifestyle data) devices you use and how/when you use them (e.g., types, model numbers, software version numbers, OS types) which will enable us to provide you with information regarding upgrades, error fixes, and software updates, and the level of Service. This information is used by us and our third-party service providers for the operation of the System, to provide the Services, to maintain quality of the System and Services, and to provide general statistics regarding use of the System. We may also use Service Information for customer support, System restoration, and research and development activities for new products and services, and other similar purposes.
Genie’s Systems may use session IDs and cookies. A cookie is a small piece of information sent by a web server to store on a web browser so it can later be read back from that browser. These technologies are used save user’s preferences for future visits, and to help us develop new tools and features for the Systems. We may collect information about your interactions with us such as the type of device or browser you're using, your IP address, the length of your stay, and the actions you take on the Systems. We may collect and store this information for each individual, on an aggregated basis, and/or a combination thereof. You can disable this feature or erase this information at any time through your web browser. However, if cookies are disabled, some of our services may not function properly.
Information Genie May Provide to Third Parties.GGenie does not sell or rent your personal information to outside unaffiliated parties except as described in this Policy. Genie may share your information with our website hosting partners and other parties who assist us in operating our Systems, conducting our business, customer service, credit card processing services, fulfilling an order for products or service, e-mail delivery, auditing, and other similar services. For example, Genie may provide your address to the shipping carrier where you have requested shipment for a purchase. Your information may also be shared with current or future Genie affiliated entities and we may release your information when we believe release is appropriate to comply with the law, enforce our Systems policies, or protect Genie’s or a third parties rights, property, or safety. However, non-personally identifiable information may be shared with other parties for other uses.
We use cookies and similar tools to remember personal information when you use the Services in order to understand and analyze trends, to administer the System, to learn about user behavior on the System, and to gather demographic information about our user base as a whole. We may use this information in our marketing and advertising both on and off the System.
Mobile Device Applications. Genie’s mobile applications (“App”) may require access to device features such as the camera, calling, location, and notifications. Access to these features may be necessary to allow you to scan a product QR code, allow you to call customer service from within the App, to set your time zone for timed events, and to notify you of status changes. You are able to prevent our App from accessing these features upon installation or through the device settings. We recommend you review the “help” or user manual for instructions on how this can be done.
When you create a user profile on the App, you may be asked to provide your name, email address, telephone number, and/or other information. A record of your controller commands, quality of your data connection, door operation history, and other technical information may be stored within the App and may be accessible through Genie’s customer service portal. Genie’s authorized employees may also have access to this information. Genie’s use of any such information will comply with this Policy.
Digital Voice Assistants.If you want to control your Aladdin Connect product through a voice control service like Amazon Alexa or Google Assistant, we may also need to collect system logs that capture usage information, detailed device data, and other account details. When you choose to connect your Aladdin Connect device to a third-party service we may share your account data and usage data with that service. In such cases, the use of your data is governed by the privacy policy of that third-party service.
Warranty Registration. If you register your warranty, Genie collects contact information including name, address, phone number, and email address. This data may be used to validate warranty claims and for marketing purposes.
Diagnostics and Remote Monitoring. Genie collects engineering data to help diagnose issues with the operation of the garage door and opener. Data includes motor current, battery levels, accessory status, temperature, humidity, incoming voltage, errors, configuration settings, and other data points about your device. You can elect to share or not share information with a third party garage door dealer by selecting ‘share data’ on the ‘my dealer’ screen. Dealer’s will use the data to communicate with you about potential maintenance and repair services to keep garage door and opener in top condition. Genie may receive compensation from the Dealer for their ability to engage with you and access your devices diagnostic data.
Marketing. If Genie sends you email advertisements, we will avoid the use of false or misleading subjects or email addresses, identify the message as an advertisement, include the physical address of our headquarters, and monitor third-party email marketing services, if applicable. You may elect to stop receiving marketing or promotional e-mails and other marketing communications at any time. To do so, please let us know by using the opt-out response device that can be found at the bottom of each such email or contacting us at the address listed above. While you can elect not to receive promotional messages, we reserve the right to send you informational emails about your account or administrative notices regarding the Systems as permitted under the CAN-SPAM Act. In accordance with Canada’s Anti-Spam Law (CASL), by accepting these terms citizens of Canada are expressly opting-in to receive marketing email communications and advertisements.
Security. Genie has implemented reasonable security measures to protect the confidentiality of personal information under our control and appropriately limits access to it. In certain areas of the System, Genie may use encryption to enhance the security of data. While Genie strives to protect your personal information, we cannot guarantee that our safeguards will prevent every unauthorized attempt to access, use, or disclose personal information. Genie urges you to take every precaution to protect your personal data when you are on the Internet. Laws and regulations guide us in how to give you notification when certain types of sensitive information are involved in a security breach. We will provide you with notice in accordance with these laws and regulations. If you become aware of a security issue, please contact Genie at the email address listed above.
Data Retention. We may retain your information for as long as your account is active; as needed to provide you products or services; as needed for the purposes outlined in this Policy or the purpose outlined in the policy that was in effect at the time the data was collected; as necessary to comply with our legal obligations (e.g., to honor opt-outs), resolve disputes, and enforce our agreements; or to the extent permitted by law.
Links to Third Party Websites. Our Systems may have links to third party websites, many of which have their own privacy policies. You acknowledge that accessing any third-party websites that are linked to this Systems is at your own risk. You should review the privacy policy of any such website you choose to visit.
Protecting Children’s Privacy. This Systems is intended for adults, and we do not knowingly collect personal information from children under 13 years of age. If you believe your child has submitted personal information to this Systems, please contact us immediately.
California Consumer Privacy Act Rights (“CCPA”). California consumers have the right to request that Genie disclose information about our collection and use of your PI over the preceding 12 months. Once we have verified your request, we will disclose what PI we have collected about you and if we have sold your PI to a third party. In the event we have sold your PI as defined by the CCPA, you may also ask to know the categories of your PI we have sold and to whom we have sold it. California consumers also have a right to request that Genie delete certain PI that we retain unless we need to retain the PI in order to do any of the following: provide goods or services to the consumer; detect or resolve issues security or functionality-related issues; comply with the law; conduct research in the public interest; safeguard the right to free speech; or carry out any actions for internal purposes that the consumer might reasonably expect. For data portability requests, we will select a format that is readily useable, and in accordance with the CCPA we will not discriminate against any consumer who chooses to exercise their rights.
California Resident Access Request To exercise the access, data portability, and deletion rights described below, California residents may submit a verifiable consumer request to Genie by either calling 833-314-0167; or emailing privacy@geniecompany.com. Your request must: (1) indicate on the subject line, “Privacy Compliance”; (2) provide sufficient information that allows us to reasonably verify you are the person about whom we collected PI or an authorized representative; and (3) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. You may also authorize an agent to submit a request on your behalf, so long as you provide the authorized agent written permission to request on your behalf, and your authorized agent additionally is able to verify their identity with us. We will respond to a verifiable request within 45 days.
Governing Law. This Privacy Statement will be governed by and construed according to the laws of the State of Texas, without regard to conflict of law principles. Any action against any party to this Policy will be commenced only in the federal or state courts within the State of Texas, which courts will have exclusive jurisdiction over such actions and proceedings. The parties hereby irrevocably consent to personal jurisdiction over them by such courts.
Policy Updates. Genie may periodically change this Policy to keep pace with new industry practices and regulatory requirements, among other reasons. Any non-material changes will take effect immediately upon posting, and we will indicate the last modified date at the top of this document. There may, however, be cases where changes to the policy may be more significant. In such cases, we will prompt you to review the new policy and require you to accept the new terms before accessing your account. However, in the event you refrain from accessing your account, your continued use of our products and services after the effective date of the new policy means that you accept the revised Policy. If you do not agree to the revised policy, please refrain from using our products or services and contact us using one of the methods listed at the top of this document to close any account you may have created.
